Introduction

At Evenflo, we appreciate the trust you have placed in us and are committed to respecting your privacy. This Privacy Policy explains the type of personal information we collect and how we intend to use it.

We understand in any given day you engage with many different companies who each have different practices for handling your data. And it can be difficult, if not impossible, to read all their policies. So, we created the below overview that highlights the points we think are important about our practices here at Evenflo:

  • What personal data do we collect? We collect the following categories of identifiers, customer records, protected characteristics, commercial information, geolocation data, internet or other electronic network activity information, and sensitive personal information. We explain those categories in more detail below.
  • How do we use your data? We use your data to connect with customers, honor contracts, conduct research and development, protect legal rights, comply with legal obligations, and protect our customers as well as others.
  • Do we sell or share your data? We allow our partners to collect details about your activity on our website and can combine it with data from other websites so they can target you with more relevant advertising (a concept sometimes known as “sharing”). Some states also consider this a sale.
  • How long do we keep your information? Typically we retain your personal information for the period necessary to fulfill the purposes outlined in this policy, unless a longer retention period is required or permitted by law.

What Personal Information Evenflo Collects

In the last 12 months, we have collected the following categories of personal information:

  • Identifiers such as names, contact information, and device identifiers.
  • Customer Records such as names and device identifiers.
  • Protected Characteristics such as gender and marital status.
  • Commercial Information such as purchase and transaction history.
  • Geolocation Data is collected based on your IP address. We do not collect precise geolocation data.
  • Internet or Other Electronic Network Activity Information such as your search history, browsing history and behavior, and details on how you interact with our website.
  • Sensitive Personal Information we collect is limited to payment information you enter when purchasing items from our website.

Evenflo’s site and services are directed toward adults, and we do not intend them for minors. We do not knowingly solicit, collect, or use personal information from users under the age of 13. How Evenflo Collects Personal Information

We collect personal information from you and your devices when you visit our sites, or otherwise interact with Evenflo (i.e., participate in surveys and quizzes, send us emails, and engage with our social media accounts or otherwise communicate with us).

How Evenflo Uses Personal Information

We generally use your personal information to operate our business, including improving our offerings and providing you the products you order. More specifically, we use personal information for:

  • Connecting with Customers. We use personal information to contact you. For example, we use your information to provide customer services, ask you to participate in surveys, give updates about your order (or items left in your cart), or highlight new offerings we think you will find useful.
  • Honoring Contracts. We use personal information to perform our contract obligations. For example, we may use your information to fulfill your order.
  • Conducting Research and Development. We use personal information to facilitate and optimize our services, such as analyzing trends, conducting market research, and personalizing our website. This may involve disclosure of personal information to third party analytics providers.
  • Protecting Our Customers and Others. We use personal information to protect the rights, property, and safety of our customers, employees, and company. For example, we may use your information in connection with responding to regulatory requirements and inquiries or complying with legal process.

How Evenflo uses Cookies, Pixels, and other Tracking Technology

When you utilize our site, we may assign you a unique identifier and send such information to your computer or device hard drive in the form of a cookie, pixel, beacon, or other similar tracking technology. Generally speaking, this is a very small bit of code that is uniquely yours. It is used to assist you in utilizing our sites, such as by keeping you logged in, remembering your preferences, and enhancing your experience.  These identifiers are also helpful for keeping track of items you put into your shopping cart including when you have abandoned your cart. We may, for example, use this information to send cart reminder messages via SMS.

You may also block cookies or turn cookies off by modifying your browser settings or settings on your device. However, in some cases, features on our website(s) may not function properly without cookies.

Because there is no common understanding about what a “Do Not Track” signal is supposed to mean, our partner platform, Shopify, does not respond to do not track signals generated by web browsers. However, we have empowered our users with other options for controlling our use of their information. If you do not want us to sell your information or make it available for targeted advertising, you can ask us not to do so by following the instructions in the rights section below or by using a universal opt-out signal (such as the Global Privacy Control).

A universal opt-out signal is a signal sent from your browser that tell us you do not want us to sell or share (make available for targeted advertising) your personal information. When we recognize the signal, we do so in a frictionless manner and only for the browser that sends it. This means that your opt-out settings will not carry over if you later access our website from a browser or device that is not sending the signal, unless you sent the signal while logged into your user account and then log into your account on the new browser.  Consult your browser or device settings to adjust settings to your preference.

We may also use your information in other ways with your consent, as necessary to comply with our legal obligations, or in connection with our internal compliance measures. We may also use your information to comply with legal obligations, to establish or exercise our rights, and to defend against a legal claim.

As noted above, we collect sensitive personal information when you enter your payment details to place an order. Given that we only use that information to process your payments, we do not use sensitive personal information for any reason other than those permitted by California Civil Code section 1798.121(a) and the related regulations.

When You Use Third-Party Sites

We are not responsible for the practices employed by any websites or services linked to or from our sites, including the information or content contained within them. We encourage you to investigate and ask questions before disclosing personal information to third parties, since any personal information you disclose will be subject to the applicable third-party’s privacy policy.

When Evenflo Discloses Personal Information

We disclose personal information to our vendors, which may be in other countries, as necessary to help us process orders, fulfill orders, send out newsletters, prevent fraud, conduct analytic services, or perform other services for us. For example, we may use other companies to ship orders placed through our website, and a credit card processing company to bill you for goods and services. We prohibit our vendors from using, keeping, or disclosing your information for any reason other than providing us the services we request.

In addition to our vendors, we may disclose your personal information to others if you request or authorize it. We may also disclose personal information (1) to comply with the law, court orders or subpoenas; (2) in connection with a government or law enforcement investigation; (3) to protect the rights, property or safety of our customers, other people, or the company; or (4) as part of a purchase, transfer, or sale of the company, its services, or its assets.

We disclose aggregated demographic information, which is data that no longer identifies a specific person, with our partners and advertisers.

As discussed further below, we may provide your information, including your name, address, email address and any transactions you conduct on our website or offline with us with third-party partners (including third party-marketing partners) and/or service providers for commercial purposes, including to deliver tailored advertising to you that match your interests when you visit our website as well as other websites. We do not, however, disclose text-messaging originator opt-in data and consent to any third parties.  

What Data Evenflo Sells or Makes Available for Targeted Advertising

We do not provide your information to third parties in exchange for money. We allow our trusted partners to collect some of your information so they can provide you targeted advertising based on your interactions with us and others online. In the last 12 months, we allowed companies to collect the following categories of personal information so they can provide targeted advertising (which some jurisdictions consider “selling” or “sharing” your information): (a) Internet or other similar network activity, such as information about a consumer’s interaction with our site including browse, add to cart, and checkout actions; (b) data about your purchases; and, (c) Identifiers, such as email addresses. We allow them to collect this information because it improves the likelihood that our advertisements reach relevant audiences.

Our site and services are directed toward adults, and we do not intend them for minors. We do not have actual knowledge that we sold or shared information on anyone who is younger than 16 years old. Users between 13 and 16 must only use the site subject to parental or guardian consent. Use by users under the age of 13 is not authorized.

 

How Evenflo Secures, Protects, and Retains Personal Information

We strive to protect your personal information and take appropriate and commercially reasonable organizational, technical, and administrative security precautions to do so. For example, when our registration/order form asks you to enter sensitive information (such as a credit card number), that information is encrypted and is protected with the customary encryption software used in the eCommerce industry. However, no measures are perfect and threats are continuously evolving. We advise you to remain vigilant. You are responsible for maintaining the secrecy of the credentials you use to access your account(s). And although we will do our best to protect your personal information, your transmission of personal information to and from us is done at your own risk. You can report any suspicious activity or concerns by contacting us as described below.

We endeavour to ensure that our employees are aware of, and comply with, their obligations in relation to the handling of personal information. Only properly authorized employees are permitted to see or use personal information held by Evenflo and, even then, only to the extent that is relevant to their roles and responsibilities.

Typically we retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law.

How Consumers Can Exercise Their Rights

We believe in empowering consumers to exercise control over their information. Consistent with our commitment to privacy, please see below for details on the various rights and choices you can exercise concerning your personal information.

While some users have specific rights guaranteed by the laws applicable in their jurisdiction, we wish to treat all our customers equally and will strive to honor requests consistently irrespective of where they live as best as we are able. However, this Privacy Policy does not create, extend, or modify any consumer or data subject rights under applicable law, or Evenflo’s obligations, except as provided by applicable law.

For all our users:

  • Update Account Information. You can access, review, update, or correct much of the personal information you have provided to us by accessing the My Account page on our website.
  • Opt Out of Marketing Messages. You can choose to stop receiving marketing messages from us. To do so, you can:
    • click the “unsubscribe” link in any email communication we send you;
    • contact us by using the resources available on our ParentLink page;
    • reply “STOP” to any text message we send you;
    • call us at 1-800-233-5921 (for our US customers) or 1-937-773-3971 (for our Canada customers); or,
  • Manage Cookie Preferences. You can adjust your cookies settings as set forth above in the section titled Cookies, Pixels, Beacons, and other Tracking Technology
  • Stop Analytics. We use third party analytic services like Google Analytics to help us understand how users interact with our website. These parties gather information by using cookies or similar technologies when you use our website as discussed above.   • Right to Access and Know. You can ask us to give you information about our collection and use of your personal information. Specifically, you can request we provide you one or more of the following: the categories of personal information we collected about you; the categories of sources from which we collected your personal information; our purposes for collecting your personal information; the categories of third parties to whom we disclose your personal information; and the specific pieces of personal information we collected about you.
  • Right to Delete. You can ask us to delete your personal information.
  • Right to Correct. You can ask us to correct any inaccurate personal information that we have about you.
  • Right to Portability. You may have a right to request a portable copy of your digital personal information.
  • Right to Opt Out of Targeted Advertising (Sharing). You can ask us to not allow third-party advertisers to collect your information on our website for targeting advertisements based on your activity across multiple websites. (A concept known as “targeted advertising” in most places and “sharing” in California.) You can exercise this right by following the instructions below.
  • Right to Opt Out of Sales. You can ask us to not sell your information and opt-out of selling or sharing of your personal information by following the instructions below. As noted above, we do not “sell” your information in the traditional sense (an exchange for money), but we do disclose it for targeted advertising—which some jurisdictions may consider a sale.

We will not discriminate against you for exercising your rights. If you email us, please use the subject line “Privacy Request” and include your name and request in the message. You may also have your authorized agent make a request on your behalf. If you have an agent making a request, we require (1) the authorized agent provide us your signed permission authorizing them to make a request on your behalf and (2) you either verify your identify with us or confirm with us that you authorized the agent to make a request for you.

In order to process your request, unless you are requesting to opt out of sales or targeted advertising, we will need to verify your identity. We do so by asking you for certain details—such as your name, address, and phone—and comparing your responses to the information we have on file. This way we make sure we only provide your information to you (or someone you authorized). Although we will not verify your identity when you request to opt out of sales or targeted advertising, we may ask you for additional information so that we can identify you.

Please use the subject line “Privacy Decision Appeal” and include in the email: (1) your name, (2) the date of the decision you are appealing, and (3) an explanation for why you disagree with that decision. California Notice at Collection

This Privacy Policy informs consumers, at or before the time of collection of consumers’ personal information, of the categories of personal information and sensitive personal information we may collect and process and the purposes for which the categories of personal information and sensitive personal information will be used. This Privacy Policy also provides consumers with information about whether that information is sold or shared, for how long the information is retained, and the rights of consumers regarding their personal information and sensitive personal information pursuant to the CCPA and CPRA.

When Evenflo Changes This Policy

In the future, we may need to update this policy as the law changes or our business continues to evolve. We will always post a current version of the policy on our website, and you can see the date at the top indicating when we last revised the policy. We reserve the right, in our sole discretion, to change this Privacy Policy at any time and will indicate when changes have been made by updating the date first set forth above. We will make reasonable efforts to notify users with an active account and email on file of substantive changes to this Privacy Policy by email.
